The Promotion of Access to Information Act 2 of 2000 (PAIA) gives you the right to request records held by a private body such as Elderbirch (Pty) Ltd when you need them to exercise or protect a right. The Protection of Personal Information Act (POPIA) also lets you ask for the personal information we hold about you. This page explains how.

2. Our PAIA manual
Our PAIA manual (section 51) describes the records we hold and how to request them. It is available free of charge on request from the information officer, by email, and will be published on this page once finalised. The Information Regulator's guide on how to use PAIA (section 10) is available from the Regulator.
3. Your own personal information — the quick route
You don't need a formal PAIA request to see your own information:
- Job seekers can see and edit everything in My profile, and download a copy of their data from Settings & privacy → Download my data.
- Employers can see their company profile, users, vacancies and invoices in the employer dashboard.
- Anyone can email the information officer to ask whether we hold information about them. Confirming this is free (POPIA section 23).
4. How to request other records
- Complete the prescribed request form (Form 2 under the PAIA Regulations, available from the Information Regulator's website).
- Describe the records you want in enough detail for us to find them, and say how you want access (a copy by email, a printed copy, or to inspect them).
- Explain which right you want to exercise or protect, and why the records are needed for it.
- Attach proof of your identity and, if you act for someone else, proof of your authority.
- Email the form to the information officer at elderbirch@outlook.com.
5. Fees
A requester who is not asking for their own personal information may have to pay the prescribed request fee, and access fees for searching, preparing and copying records, as set in the PAIA Regulations. A deposit may be asked if the search and preparation will take more than six hours. We will tell you the fees in writing before we do any work, and we refund any deposit if access is refused.
6. How long it takes
We decide on a request within 30 days of receiving it (section 56). We may extend this once, by up to 30 more days, if the request is for a large number of records or needs consultation, and we will tell you why (section 57). If we do not respond in time, the request is regarded as refused (section 58).
7. Grounds for refusal
PAIA requires or allows us to refuse access in some cases — for example to protect another person's privacy (section 63), third parties' commercial or confidential information (sections 64 and 65), someone's safety (section 66), legally privileged records (section 67) or our own commercial information (section 68). If we refuse, we will give reasons and, where possible, give access to the part of the record that can be released.
8. Records we hold
- Company records: incorporation documents and statutory registers.
- Financial and tax records: invoices, payments and accounting records.
- Job seeker records: profiles, CVs, documents, applications, consents and the placement register.
- Employer and client records: accounts, subscriptions, vacancies, recruitment requests and placement agreements.
- Communications: enquiries, messages and reports made through the website.
- Operational records: agreements with service providers, and website security and activity logs.
Information published on this website — vacancies, the public register, company profiles and these legal pages — is available without a request.
9. If you are unhappy with the outcome
You may lodge a complaint with the Information Regulator within 180 days of our decision (section 77A), or apply to court (section 78).
